Description
This course covers the legal procedures that an enforcement or compliance officer must follow 1) to investigate and to report workplace accidents, and 2) to participate in a proceeding before an administrative tribunal and courts. It also covers the procedures that apply to prosecuting regulatory or public welfare offences including environmental & OHS offences. Students will study the sources of the procedural rules, including Workers Compensation Act (WCA), the Occupational Health and Safety Regulation, Environmental Management Act (EMA), Canadian Environmental Protection Act (CEPA), Contaminated Sites Regulation, Administrative Tribunals Act (ATA), Canadian Charter of Rights and Freedoms, Criminal Code, Canada Evidence Act, and BC Offence Act & the BC Evidence Act.Registration in this course is restricted to students admitted to the Post-Degree Diploma in Health, Safety, and Environmental Compliance.
